Trademark registration in Kazakhstan (Kazpatent)

Kazpatent, the national patent office, examines every application, and the full examination takes up to 7 months. We search the register, pick the classes, prepare the application and answer the examiner's requests, so you know the risks before you pay the state fees. Kazpatent makes the final decision.

In short

  • Kazpatent (the National Institute of Intellectual Property under the Ministry of Justice) runs a preliminary examination of about 1 month and a full examination of up to 7 months from filing.
  • A registered trademark is valid for 10 years and can be renewed.
  • A foreign owner can act only through a Kazakh patent attorney. A Kazakh LLP files itself, and a small or medium business pays reduced state fees until 1 January 2028.
  • Kazakhstan is in the Madrid system: an international registration can cover it, and since 7 July 2025 WIPO charges a separate Kazakh fee for that.

Where trademark plans go wrong

We have sold under this name in Kazakhstan for a year. Do we really need to register it?

Protection comes from registration with Kazpatent. Until you file, someone else can file a similar mark first. We start with a search of the register and tell you what we find.

Our parent company abroad owns the brand. Can our Kazakh LLP file for it?

It can, but then the LLP owns the mark, not the parent. If the parent files, the law requires a Kazakh patent attorney. We set out both routes with fees and ownership before you choose.

We already have an international registration. Does it protect us in Kazakhstan?

Only if Kazakhstan was designated in it. If not, you can add Kazakhstan through WIPO or file with Kazpatent directly. We compare cost and timing.

What we do

  • Search before filingWe check identical and similar marks in Kazpatent's register before you pay any state fees, and name the refusal risks plainly.
  • ClassesWe pick the classes of the international (Nice) classification for what you actually sell, since the fees grow with every class above three.
  • Who owns the markThe foreign parent, your Kazakh LLP or the founder: we compare ownership, fees and how the mark will be used.
  • Application and filingApplication, image of the mark and the list of goods and services, filed with Kazpatent. For a foreign owner the filing goes through a registered Kazakh patent attorney.
  • Examiner's requestsAnswers to Kazpatent's requests and objections within the deadlines.
  • Certificate and renewalWe record the 10-year term and remind you about renewal ahead of time.

How registration goes

  1. Brief and searchWhat you sell, where, and whether the mark is already in use. Then a search of the register.
  2. Classes and applicantClasses, owner and route: a national filing or a designation through the Madrid system.
  3. FilingApplication and state fees. The preliminary examination takes about 1 month, or 10 business days if accelerated.
  4. Publication and full examinationThe application is published and third parties have 2 months to object. The full examination takes up to 7 months from filing, or 3 months if accelerated.
  5. RegistrationIf Kazpatent approves the mark, it goes into the state register and a certificate is issued for 10 years.

What changes the price

  • number of classes
  • a foreign owner through a patent attorney or a Kazakh company
  • standard or accelerated examination
  • whether the examiner raises objections

Kazpatent's state fees follow its 2026 tariff and depend on the number of classes and the applicant: a legal entity, a small or medium business or an individual. We list them in the estimate.

Common questions

How do I register a trademark in Kazakhstan?

You file an application with Kazpatent, pay the state fees and pass two examinations, preliminary and full. A foreign owner files through a Kazakh patent attorney; a Kazakh company can file itself.

How long does trademark registration take in Kazakhstan?

Up to 7 months from filing under the standard procedure. Accelerated examination shortens the full examination to 3 months for an extra state fee.

How much does it cost to register a trademark in Kazakhstan?

State fees follow Kazpatent's 2026 tariff: they grow with the number of classes and are lower for small and medium businesses until 1 January 2028. Our fee depends on the search and the classes, and we name it after a short brief.

Can a foreign company register a trademark in Kazakhstan?

Yes, but only through a registered Kazakh patent attorney. Another route is to register the mark to your Kazakh LLP, if the brand will be used through it.

Does a Madrid registration protect my brand in Kazakhstan?

Only if Kazakhstan is designated in it. Since 7 July 2025 WIPO charges an individual Kazakh fee for each designation. A separate EAEU trademark covers all Eurasian Economic Union countries with one application.

How do I check whether a trademark is registered in Kazakhstan?

Kazpatent publishes the state trademark register on its website. A search for an identical name is quick; similar marks and related classes need a professional check, which we do before filing.

How long is a trademark valid in Kazakhstan?

10 years, and the registration can be renewed. Renewal has its own state fee, so we remind you ahead of the deadline.
